Privacy Policy for Candidates

Ashtrom Group Ltd., Company No. 510381601 (hereinafter, collectively, “Ashtrom” and/or “the Group”), respects and protects the privacy of candidates for positions offered by Ashtrom and/or any of the companies within the Ashtrom Group (the “Candidate(s)” and the “Positions,” respectively).

The privacy policy detailed below explains the sources from which Ashtrom collects personal information and sensitive information, as these terms are defined in the Privacy Protection Law, 1981 (the “Law”), regarding the Candidate, including within the framework of submitting and/or reviewing their candidacy for a position (collectively, the “Information”). It further describes the purposes for which Ashtrom collects the Information, the types of Information collected, and the possible uses of such Information.

This document is written in the masculine form for convenience only and is intended for all genders equally. 

The Candidate is aware that the Information he provides when submitting his candidacy for a Position, as well as information that will be collected about the Candidate in connection with the review of his candidacy and/or the screening and recruitment process, will be stored in Ashtrom Group Ltd.’s database for the purposes set forth below in this Policy.

The Candidate is not legally required to provide personal information to any of the Group’s companies, and the provision of such information is made voluntarily and with his consent. However, the Candidate acknowledges that if he chooses not to provide the information, the companies in the Group may be unable to review his candidacy and/or the recruitment and screening process for the Position may not be completed.

 

  1. Sources of Information

Ashtrom receives and collects information about the Candidate from the following sources:

1.1. Information provided by the Candidate to any of the Group’s companies as part of submitting and/or reviewing his candidacy for a Position, including via the Group’s websites and/or by email and/or telephone calls and/or through questionnaires and/or documents and/or declarations and/or other information the Candidate provides to any of the Group’s companies. The foregoing information may also be collected in the course of interviews and/or tests (e.g., personality, aptitude, and integrity assessments) and/or from social networks and/or the internet.

1.2. Information received by any of the Group’s companies about the Candidate from third parties, such as HR agencies, external recruiters, job boards and/or recruitment platforms, former employers, social-network platforms, screening companies, and others;

1.3. Any additional information received by any of the Group’s companies during, and in connection with, the review of the Candidate’s application.

 

2.    Types of Information Collected by Ashtrom About the Candidate

The information Ashtrom collects about the Candidate may include the following types of information:

2.1. Information collected in the course of submitting an application via the recruitment website, including the Candidate’s résumé/CV; demographic information (age, gender, country of birth, marital status, citizenship, etc.); email address; full name; mobile phone number; national ID number; and residential address.

2.2. Information collected in connection with assessing the Candidate’s suitability for the position, including prior work experience, education, training, and/or any additional information the candidate chooses to include in the résumé/CV and/or in documents provided to any of the Group’s companies and/or their representatives.

2.3. In the course of reviewing the candidacy for the position, including through interviews and/or telephone calls, the Group’s companies may collect additional information, such as interview summaries, references and/or opinions and/or letters of recommendation (including from former employers), results of employment-related tests, certificates evidencing various qualifications, and/or any other information the Candidate chooses to provide to the Group as part of the review of his candidacy.

2.4. Information regarding criminal history and information concerning medical and/or mental condition.

 

3. Purposes for Which Ashtrom Collects the Information

Ashtrom collects Information about the Candidate for one or more of the following purposes:

3.1. For and in connection with reviewing the candidate’s application and/or suitability for the position;

3.2. For the purpose of contacting the candidate;

3.3. For managing, analyzing, and improving Ashtrom’s recruitment and screening processes, including the candidate experience.

3.4. For analysis, research, and the preparation of statistics (including for the purpose of improving the recruitment process) and for transferring processed, statistical, or other information to third parties, provided that such information does not enable the identification of the Candidate;

3.5. For defending against claims, demands, and allegations made against any of the Group’s companies and/or their representatives, as well as against third parties;

3.6. For enforcing this Privacy Policy and/or any agreement and/or terms of use applicable between any of the Group’s companies and the candidate (to the extent applicable).

3.7. For compliance with any applicable law and/or directives of authorities;

3.8. To contact the candidate with offers for new and/or additional positions or opportunities that may match the candidate’s job search, for the purpose of identifying potential fits for roles within any of the Group’s companies.

3.9 To safeguard the Group’s information, property, and assets, including by preventing the disclosure of trade secrets, protecting and enforcing intellectual-property rights (including copyrights), and defending the Group’s economic, security, and other legitimate interests.

3.10 To manage Ashtrom’s business operations and to act in accordance with its policies and internal procedures, including those governing audits, bookkeeping, finance and account management, billing, collections, and information systems.

 

4. Disclosure of Information to Third Parties

4.1. Ashtrom shall not transfer or disclose any Information to third parties except as detailed in this Privacy Policy.

4.2. Any transfer of Information to third parties shall include only relevant information that does not exceed the purposes for which the Information is being transferred, and shall be carried out proportionally and solely for a defined, explicit, and legitimate purpose.

4.3. Ashtrom may transfer the Information collected by it, in whole or in part, to third parties in one or more of the following circumstances:

4.3.1. When Information is received by one of the companies within the Group, that company may transfer the Information to other companies within the Group for the purposes of collecting and processing the Information as detailed in this Privacy Policy. Such purposes include managing the Group’s recruitment process and/or reviewing the candidate’s application for a Position and/or managing the Group’s human resources, as well as assessing the candidate’s suitability for other and/or additional positions and/or offering the candidate other and/or additional positions available within the Group’s companies.

4.3.2. Third parties that provide any of the Group’s companies with various services, including recruitment, onboarding, and placement services; candidate-sourcing, screening, and management platforms and engines; IT and security system support services; data-storage services; website-development services; printing services; survey-administration services; advertising and marketing service providers; attorneys; accountants; communication providers; and other external professional consultants, as well as additional third parties providing Ashtrom with services related to its operations—for the purpose of reviewing the candidate’s application, conducting the recruitment process, and/or fulfilling the purposes of Information collection as detailed above.

4.3.3. If Ashtrom receives an instruction— including a court order—requiring it to disclose the Candidate’s details or information about the Candidate, in accordance with applicable law.

4.3.4. In any dispute, claim, demand, lawsuit, or other legal proceeding between the Candidate (or anyone acting on the Candidate’s behalf) and Ashtrom (or anyone acting on Ashtrom’s behalf).

4.3.5. In the event of a transfer, sale, and/or acquisition of Ashtrom and/or its assets, in whole or in part, whether for consideration or without consideration, including, but not limited to, a merger of any of the Group’s companies and/or their operations with third parties, and/or a reorganization, and including, without derogating from the generality of the foregoing, any full or partial change of control in any of the Group’s companies, as well as in connection with assessing the feasibility of any of the foregoing.

 4.3.6. If a claim is raised, or Ashtrom has a suspicion, that a candidate has committed an act that may harm Ashtrom, anyone acting on its behalf, or any third party.

4.3.7. Whenever Ashtrom believes that disclosure of the Information is required to prevent harm to any of the Group’s companies, to the candidate, or to any third party.

4.3.8 In addition to the foregoing, Ashtrom may transfer the Information to third parties, as stated above, also outside the State of Israel, including to third parties located in countries that may provide a level of protection that is lower than that afforded under Israeli privacy laws. Approval of this Policy constitutes the Candidate’s consent to the transfer, retention, and storage of Information by such third parties.

5. Information Security

Ashtrom implements technical and physical measures regarding privacy and information security in accordance with applicable law. The candidate acknowledges that storing and transmitting information by electronic means, including via the internet, can never be completely secure, and that whenever the candidate provides information to any of the Group’s companies - particularly through the internet - the candidate does so with full consent and subject to the risks inherent in such transmission. Ashtrom does not undertake that the online platforms through which the candidate may be screened and/or submit an application, including the Group’s websites, will be absolutely immune from unauthorized access to the information stored therein. In any event, if the candidate has reason to believe that the transmission of information to any of the Group’s companies is no longer secure, please contact us using the details set out in Section 14 of this Policy.

 

6.      Disclaimer of Liability

Ashtrom and anyone acting on its behalf shall bear no liability and shall be exempt from any responsibility in connection with any damage, loss, or expense of any kind or nature, whether direct, indirect, incidental, or consequential, that has been or may be caused to the candidate and/or any third party in relation to the collection of the Information, its use, transfer to third parties, retention, security, and any related matter.



7.      Data Retention Period

Ashtrom will retain the candidate’s Information for the period necessary to fulfill the purposes set forth in this Privacy Policy, unless a longer retention period is required or permitted by law.

 

8.  Providing Information About Other Individuals

If the candidate provides Ashtrom with information about third parties, including the candidate’s family members and/or acquaintances, the candidate shall do so only after: (a) informing such third parties of the contents of this Policy; and (b) obtaining the consent required for the collection, use, disclosure, and transfer of personal information about the third party in accordance with this Policy and with applicable law, to the extent required.

 

9. Links and Hyperlinks

9.1. Ashtrom’s websites may contain links, hyperlinks, or banners directing to other sites that are not monitored or reviewed by Ashtrom, including with respect to their reliability, legality, security, or their privacy policies.

9.2. Ashtrom shall not be liable for any use made by candidates of external links appearing on Ashtrom’s websites and/or on websites that link to Ashtrom’s sites, for pages not hosted on Ashtrom’s websites, or for any other third-party sites (including recruitment platforms and/or job boards and/or job-advertising websites).

9.3. Candidates undertake to comply with the terms and conditions of such websites or webpages and to engage directly with the providers of those sites/pages regarding any matters arising in connection with access, browsing, use, and the like.

9.4. Accordingly, Ashtrom shall bear no responsibility of any kind with respect to such other sites, including the collection, use, or transfer of information on those sites, the content published on their pages, and any related matters.

 

10. Right of Access and Rectification

If the Candidate wishes to review or correct the Information pursuant to Sections 13 and 14 of the Privacy Protection Law, the candidate may do so by contacting us using the contact details set out in Section 14 of this Policy.

 

11. Governing Law and Jurisdiction

11.1. The terms and provisions set forth in this Policy, as well as any amendment or modification thereto, shall be governed by the laws of the State of Israel, without regard to its conflict-of-law provisions.

11.2. The exclusive jurisdiction over any dispute and/or claim arising from or relating to this Policy shall lie with the competent courts in Tel Aviv -Jaffa.

 

12. Changes and Updates

Ashtrom may, at its sole discretion, change and update this Privacy Policy from time to time, without the need to provide notice or warning. The current version of the candidate Privacy Policy, as published on the Group’s website and/or via other interfaces with the candidate (e.g., candidate screening and recruitment platforms), shall be binding upon the Candidate. The candidate’s continuation of the recruitment process after such update shall constitute the candidate’s consent to the updated Privacy Policy, including any changes thereto.

 

13. Miscellaneous

13.1. The candidate may not assign his rights and/or obligations under this Privacy Policy to any other party. The Group may assign its rights and/or obligations to another party.

13.2. Nothing in this Privacy Policy shall derogate from any right afforded to any of the Group’s companies and/or anyone acting on their behalf under any applicable law.
